AdsNet Data Processing Agreement (DPA)

Effective Date: [09 June 2026]

1. Purpose

This Data Processing Agreement forms part of the agreement between AdsNet and the Client.

It applies whenever AdsNet processes personal information on behalf of the Client.

2. Definitions

For purposes of this Agreement:

Client means the party using AdsNet services.

Personal Information has the meaning assigned under POPIA.

Processing includes collection, storage, organisation, transmission, retrieval, modification or deletion of information.

Operator means AdsNet when processing information on behalf of the Client.

3. Scope of Processing

AdsNet may process personal information for purposes including:

  • Landing page hosting
  • Lead collection
  • Lead routing
  • Dashboard functionality
  • Reporting
  • Support services
  • Campaign management functions

AdsNet shall not process information beyond what is reasonably necessary to provide the service.

4. Client Instructions

The Client instructs AdsNet to process information as necessary to:

  • Provide the agreed services
  • Deliver leads
  • Generate reports
  • Maintain platform functionality
  • Provide support

The Client warrants that all instructions provided are lawful.

5. Client Responsibilities

The Client remains responsible for:

  • Determining processing purposes
  • Obtaining consent where required
  • Providing privacy notices
  • Maintaining legal compliance
  • Responding to data subject requests where applicable

6. AdsNet Responsibilities

AdsNet shall:

  • Process information only as reasonably required
  • Maintain reasonable security safeguards
  • Restrict unauthorised access
  • Assist with compliance where reasonably possible
  • Notify the Client of significant security incidents where required

7. Sub-Processors

AdsNet may use service providers including:

  • Hosting providers
  • Email providers
  • Analytics providers
  • Infrastructure providers
  • Security providers

AdsNet shall take reasonable steps to ensure such providers are appropriate for the services supplied.

8. International Processing

Where data is processed outside South Africa, AdsNet will take reasonable steps to ensure appropriate safeguards exist.

9. Limitation of Liability

AdsNet shall not be liable for losses arising from:

  • Client instructions
  • Client misuse of data
  • Third-party service failures
  • Events beyond AdsNet’s reasonable control

10. Termination

Upon termination of services, AdsNet may retain information where reasonably necessary for:

  • Legal compliance
  • Auditing
  • Security
  • Dispute resolution
  • Backup and recovery processes

11. AdsNet User Data Deletion Instructions

AdsNet respects your right to request deletion of personal information associated with your use of AdsNet services and integrations.

If you have used AdsNet through a Meta or Facebook integration and would like to request deletion of personal information associated with that integration, you may submit a deletion request to AdsNet.

12. How to request deletion

Send your request through the AdsNet Contact page and state that you are requesting User Data Deletion.

Please provide sufficient information for AdsNet to identify the relevant account or interaction, such as the email address associated with your AdsNet account. Do not send passwords, access tokens or other security credentials.

AdsNet may contact you to verify your identity before processing the request.

13. What happens after a request

Once a valid deletion request has been verified, AdsNet will delete or anonymise applicable personal information that it controls and that is no longer required for the provision of services.

Some information may be retained where reasonably necessary for legal compliance, accounting, security, fraud prevention, auditing, dispute resolution or other legitimate record-keeping requirements. Where information must be retained, it will remain subject to applicable privacy and security safeguards.

14. Meta and Facebook data

Where the request concerns information obtained through a Meta or Facebook integration, AdsNet will process applicable information held by AdsNet in accordance with this deletion process. Information held independently by Meta is subject to Meta’s own privacy and data-management processes.

15. Request Deletion

Please use the subject or message heading “User Data Deletion Request.”

16. Governing Law

This Agreement shall be governed by the laws of the Republic of South Africa.
